High Court rules McBride suspension was 'unlawful'

The High Court in Johannesburg has ruled that Police Minister Nathi Nhleko's decision to suspend Independent Police Investigative Directorate (Ipid) head Robert McBride was unlawful and invalid.

EWN reporter, Mia Lindeque said this order must first be confirmed by the Conistitutional Court before taking effect.

Lindeque said McBride sees the ruling as a victory, although he will remain suspended until Parliament's committee decides on whether to constitute a fresh disciplinary hearing.

The judge has given Parliament 30 days to institute new disciplinary charges, if they wish to do so. If Parliament decides not to constitute the hearing and the Constitutional Court confirms the order, he could return to work as soon as next year.
