Zuma and NPA lawyers back in court to battle spy tapes ruling

Lawyers for President Jacob Zuma have taken their arguments back to the Pretoria High Court today, seeking to appeal a decision against the president regarding corruption charges.

They claim the court should not have found former NPA acting head Mokotedi Mpshe acted secretly, and disingenuously, when he withdrew the charges against Jacob Zuma.

The charges stem from the conviction of Schabir Shaik for corruption in 2006.

EWN reporter Barry Bateman is following the case and is at the High Court.

He says the NPA are arguing that the decision interferes with prosecutorial discretion. Submissions by the lawyers representing both the NPA and Jacob Zuma are arguing that these issues raise important constitutional questions.

The response from Deputy Judge President Aubrey Ledwaba was well then why don't you then immediately approach the Constitutional Court.

The lawyers said they wanted to follow this route first, but Bateman says it will probably end up in the Constitutional Court. he says the court will likely grant the application.

It's been a 6 year court battle. It doesn't look like the charges will be reinstated against President Zuma any time soon.
