City of Tshwane can drop old apartheid era street names rules ConCourt

The long standing dispute between the city and Afriforum has finally come to some resolution.

EWN's Gia Nicolaides reports from the Constitutional Court, where Chief Justice Mogoeng Mogoeng spent over an hour discussing the importance of heritage and paving a way forward for the future.

(Judge Mogoeng) said that apartheid and colonialism is so harmful that it retards our progress as a nation, and the past must not be pampered with great care or sympathy.

Mogoeng argued that the desire to keep the old names was "selfish and divisive".

Today the Constitutional Court set aside the interim court order requiring both old and new street names to be displayed alongside one another.

The old names will now need to be taken down. Afriforum have a review pending later this year and can argue for this to be overturned.

Legal representative for Afriforum, Werner Human, spoke to Stephen Grootes about the ruling. He says Afriforum has the greatest respect for the courts and their judgements.

When we talk about the 25 street names in total that has been challenged in court, it doesn't follow that all 25 street names...that we have no room or flexibility, pertaining to all the names.

He says it is about the legal grounds for the decision by Council, rather than the merits of the names both old and new.

Human does concede many people would find the old names offensive.
