If Pravin Gordhan has a case to answer, he must do so - analyst

Finance Minister Pravin Gordhan has been issued with a formal summons to appear in court on 2 November for fraud.

The charges relate to Gordhan sanctioning Former Sars Deputy Commissioner Ivan Pillay early retirement payout.

National Director of Public Prosecutions Shaun Abrahams has dismissed any suggestions that the decision to charge Gordhan was political.

Aubrey Matshiqi, political analyst says this will be fought both in the court of public opinion as well as in South Africa's courts and "the manner in which the battle has been fought and the responses which it has attracted has suggested that the rule of law has been prostituted in pursuit of narrow political ends."

Matshiqi says if the Finance Minister has a case to answer, he must do so.

Unfortunately we have reached a situation where too many South Africans think we must choose between the rand and the rule of law.

Aubrey Matshiqi, Political Analyst

Matsheqi says he is not certain that the charges against Gordhan are above the rule of law however he says the rand should never be more important than the rule of law.

EWN Dineo Bendile reported from the Gauteng government's open tender seminar in Midrand on Tuesday that despite being notified minutes earlier of the summons issued to him, Gordhan continued to give the keynote address.

Gordhan's speech on combating fraud and corruption was received with applause. Gauteng Premier David Makhura also said he stands by Gordhan despite this summons.
