Gupta lawyer says family not given enough time to reply to State capture report

A statement by the Gupta family on Tuesday refers to Public Protector Thuli Madonsela's State capture report saying that she is trying to damage Jacob Zuma before she leaves office on Friday.

Lawyer Gert van der Merwe, representing the Gupta's, joined Stephen Grootes on the line form Tshwana and says her interpretation is not accurate.

I am not convinced she is biased. I think that might be a misunderstanding. What we are saying is that she has not followed due process, as far as the family is concerned, to bring the final report out.

He says the Public Protector's office informed them the final State capture report will be released on Friday. He says while he is in full support of the office and the work they do and believes Madonsela is in a position to 'bring out a proper report'.

But our concern is due process isn't being followed.

A meeting was arranged two weeks ago to give him an opportunity to present a version of events, but he claims that he was informed the final report will be released on Friday.

The Public Protector Act gives any person the right to be heard on his version if an adverse conclusion is to be made against such a person.

He does not want to delay the process but feels he has not been given the opportunity to bring his witnesses to put their version of events to the Public Protector - in particular the Mcebisi Jonas meeting, details he cannot disclose in terms of the Act.

The Gupta's will not go to court to stop her releasing the final report. But should an adverse finding be made about the family, he will go to court and take the report on review.
