Judge orders state capture report be preserved until release

Outgoing Public Protector Thuli Madonsela appeared at the Pretoria high court to oppose Des van Rooyen’s interdict application to stop her from releasing her report into the state capture investigation.

Several opposition parties arrived at court in support of Thuli Madonsela. Economic Freedom Fighters (EFF) leader Julius Malema also arrived at court, and has been seen speaking with the legal teams.

According to EWN reporter, Barry Bateman, the application by Des Van Rooyen has been postponed as well as Jacob Zuma's application that was due to be heard on Tuesday.

The matter will be heard on 2 November.

There is also an agreement that Madonsela's report in its current form, will not be released pending the outcome of the court decision on the two applications.

Bateman says the opposition parties showed concerns that if the report is not released by Thuli Madonsela "it will not see the light of day".

However, the Judge has suggested that an order be made to preserve the current report, and later the court will order the next Public Protector to release the report in its original form.

EWN reporter Gia Niccolaides says the British Broadcasting Corporation (BBC) claims that there is damning cell phone evidence which forms part of Thuli Madonsela's investigation, showing that van Rooyen was at the home of the Guptas the night before he was appointed Finance Minister.
