Advocate Paul Hoffman says there is no concrete confirmation regarding the existences of a preliminary report into Absa.
It's reported that Public Protector Busisiwe Mkhwebane found that Absa could be liable to pay back more than R2.2bn for an unlawful apartheid-era bailout.
Hoffman was the first to initiate a complaint with former public protector Thuli Madonsela, asking for an investigation.
He says that media and the office of the public protector have different stances on the existence of a preliminary report.
"I communicated with the Public Protector who told me there is no provisional report... now the press is telling me that there is a provisional report... It's very disturbing."
Public Protector Busisiwe Mkhwebane was invited to reply, but her office declined to comment.
