Minister Oliphant's attempt to remove labour registrar was unlawful

The Labour Appeal Court ruled that Minister of Labour, Mildred Oliphant's attempt to remove Johan Crouse as union registrar was unlawful.

Oliphant tried to remove Crouse after he brought a court application to deregister the Chemical, Energy, Paper, Printing, Wood and Allied Workers Union (Ceppwawu) for not providing its financial reports for four years.

Gavin Brown, an independent labour analyst, says the minister has interfered in what is a fairly routine process in the registrar's office.

The registrar as a matter of routine deregisters unions or organisation throughout the year who are found to be not complying to meet financial returns.

It is very unusual for the minister to get involved in this. This is an administrative process where the registrar is well in his power to perform and is required to perform it by Labour Relations Act.
