Fees Must Fall activist Bonginkosi Khanyile says his revolutionary spirit has been revived after surviving five months behind bars.

I've survived prison unbroken. I feel I am revived. My commitment to the call for free education has been revived.

Khanyile was granted bail of R250 in the Constitutional Court on Wednesday, following his arrest last year at the height of demonstrations over the cost of higher education.

Khanyile says he was not imprisoned because he is a criminal, but rather because he was shaking the status quo by demanding free education.

When we push government to give us free education, they decide to arrest us. Our arrest is precisely because we are fighting for free decolonised education in our lifetime.

He has thanked his fellow student activist, religious leaders, academics and other citizens who have supported him during his incarceration and failed court bids.

Khanyile revealed that he is indeed a member of the Economic Freedom Fighters (EFF) and says leader Julius Malema, among others, has been very supportive throughout the case.

He says that the ANC has managed to infiltrate the courts in KZN.

The problem is in KZN because the ANC government has infiltrated the courts. The problem is because of the political infiltration.

I was denied bail primarily because I pushed for free education and the ANC has declared KZN a no-go area for protests. And equally, I'm an EFF member so things were made difficult for me.

He says that his experience has inspired him to consider studying law in an effort to decolonise what he call an unjust judiciary.

The DUT student says the fallist movement is not defeated and will gather to plot a way forward.

Meanwhile, advocate of the high court James Grant talks about the politics and constitutionally of the case as well as the decision made by the lawyers court to deny Khanyile bail.
