SA should try change imperfect ICC from within rather than leave - Zak Yacoob

Former Constitutional Court judge Zak Yacoob says international human rights justice can only be achieved if countries give up their sovereignty.

He has responded to a decision announced on Tuesday night by government, to revoke its withdrawal from the International Criminal Court (ICC).

Last year government made clear its intention to leave, after being accused by the ICC of disregarding an order to arrest Sudanese President Omar Hassan al- Bashir who has been implicated in genocide and war crimes.

It is an imperfect system, but better to join it rather than not join it.

Zak Yacoob, Former Constitutional Court judge

As far as our sovereignty is concerned, international human rights justice, if it is to be achieved properly – involves countries giving up their sovereignty.

Zak Yacoob, Former Constitutional Court judge

The sovereignty argument sounds like South Africa in the olden days saying we are entitled to carry on with the policy of apartheid however evil it may be, regardless of what other countries say because we are sovereign.
