'I've never seen a judgment of the highest court be so critical and scathing'

Pierre de Vos, Constitutional law expert, says it was the human rights organisation, Black Sash that approached the Constitutional Court over the South African Social Security Agency (Sassa) and Cash Paymaster Services (CPS) matter.

Minister of Social Development Bathabile Dlamini has now been compelled to explain her position and why she shouldn't be held personally liable for grants crisis.

The court said Sassa and the minister did not comply with the original order.

There were only two options, they either had to do the grants themselves or they'd have to do a tender. They did neither.

De Vos says this means the court might find the minister in contempt of court and for that reason may have to pay for the court case from her own pocket.

That is quite astonishing thing for the courts to even consider doing.
