Police Minister, Nkosinathi Nhleko, has confirmed that he is going to appeal the Pretoria High Court's decision that the appointment of Major-General Berning Ntlemeza be set aside because he was found by the courts to be a liar.
In 2015, Judge Elias Matojane found Ntlemeza lacked integrity and found him to be dishonest. He concluded that Ntlemeza attempted to mislead the court by making false statements under oath.

Ntlemeza says that he looked at the Matojane judgment and accepted a version from Ntlemeza and found there were no adverse finding against him.— Barry Bateman, EWN reporter
The Pretoria High Court found that the Police Minister failed to take into account adverse findings against Ntlemeza when he made the decision to appoint him.
