Mxolisi Nxasana has claimed in legal papers that President Jacob Zuma lied under oath about him willingly leaving his position as National Director of Public Prosecutions.

The former National Prosecuting Authority (NPA) head filed papers in an application brought by Corruption Watch and Freedom Under Law aimed at trying to recover the R17 million paid to Nxasana when he left the NPA.

Director of the Council for the Advancement of the South African Constitution (Casac), Lawson Naidoo, says the contents of Nxasana's affidavit should be a huge cause for concern.

The story that he paints is that he was forced out of office and that there was an abuse of public power by the President, the Minister of Justice and Minister of State Security.

He states very simply that he had never at anytime sought to be relieved of his duties, which is what the President had alleged in his own affidavit in this matter.

In a legal document filed by Zuma as part of this case, he says that Nxasana asked to leave the NPA.

However, Nxasana has filed his own papers in which says “the President's version in this regard is false".

Mr Nxasana clearly states that the President's version is false.

Naidoo says Zuma has failed to produce the documents showing that Nxasana requested to leave office.

He believes that there was a campaign started by the NPA's Nomgcobo Jiba and Lawrence Mrwebi, who were struck off the roll of advocates, to force Nxasana to leave office.

Nxasana says he is willing to resume his duties and pay back the R17 million that was given to him upon his exit.
