Law allowing government to spy on citizens being challenged

The amaBhungane Centre for Investigative Journalism is challenging the constitutionality of the Regulation of Interception of Communications and Provision of Communication-Related Information Act (Rica).

Amabhungane says there are fundamental flaws in the law and that various sections are inconsistent with the Constitution.

AmaBhungane's Sam Sole says the law allows for the lawful interception of citizens’ communications.

Sole says the law needs to be revised.

Rica was drafted at the time when most Parliamentarians thought of interceptions and surveillance, some policemen attaching wires to telephone line, sitting next door and listening to the conversations.
