Ntlemeza to return state vehicle, but warns Mbalula to stop interfering

Major General Berning Ntlemeza will comply with the requests made by Police Minister Fikile Mbalula, his lawyer Comfort Ngidi has confirmed.

At the same time, Ngidi says his client has given Mbalula until the end of Monday to cease from interfering in Ntlemeza's "duties".

We have given the Minister of Police until the end of business today to withdraw from interfering with him [Ntlemeza], failing which we have been instructed to approach the appropriate court to enforce the rights of the employee.

This comes after Mbalula instructed acting national police commissioner Khomotso Phahlane to recover a state vehicle and Hawks-issued cellphone from Ntlemeza.

Major General Berning Ntlemeza is still employed by the unit.

As we understand the law, he had the vehicle because he was executing his duties.

He's returned the vehicle, but at the same time he is going to exercise and enforce his rights to not have the minister interfere with him while he's doing his duties.

Ntlemeza reported for duty on Monday morning, despite the Pretoria High Court order that his appointment be set aside.

It's alleged that he barged into a management meeting this morning and ordered the head of supply chain management to give him a state vehicle.

Ntlemeza still Hawks boss and High Court decision suspended, argues lawyer

At the same time, Ngidi claims the High Court ruling which sets aside Ntlemeza's appointment with immediate affect has been suspended, after his client filed an appeal on Friday.

I hear the minister says we did not appeal on Friday, but we did.

It automatically suspended the decision of the High Court, pending the appeal.

The minister's action, in our view, is premature. Until the appeal is heard, the General is still the head of the Hawks.
