Watch your complaints on social media, companies can sue you

Social media sites like Facebook, Twitter and LinkedIn have become the most effective and immediate way of conveying information.

A caller phoned in this week asking what recourse do business owners have when defamed on social media.

Xolani Gwala speaks to social media law expert, Emma Sadleir, about legal issues related to social media posts.

Sadleir says companies can sue individuals for defamation over social media posts to correct and cure harm done to reputation of companies.

She explains what constitutes defamation according to South African law.

You just have to show the content was published. It must refer to you or your company, directly or indirectly. And it must hurt your reputation.

Emma Sadleir, social media law expert

In South Africa you are allowed to defame companies provided what you are saying is both true and for the benefit of the public.
