Brian Molefe set to challenge Eskom and Brown in court

Former Eskom CEO Brian Molefe has approached the Labour Court, serving papers on both Eskom and Minister Lynne Brown after they rescinded the decision to reappoint him.

The Eskom board and the Public Enterprises Ministry have confirmed receiving legal communication informing them of Molefe’s decision to fight his dismissal at the Labour Court on Monday.

Xolani Gwala spoke to labour relations attorney Tony Healy on whether Molefe has any grounds to take legal action against the parastatal and Brown.

I think he is going to struggle in the sense that, my opinion is his reappointment into the position in the first place was unlawful.

You can't be unlawfully removed from a position you are unlawfully appointed to in the first place.
