Former Eskom CEO, Brian Molefe is fighting his dismissal from the power utility in the Labour Court. Molefe wants his dismal declared unlawful and void.

Michael Bagraim, labour lawyer says the embroilment of Molefe and Eskom began and will end in a disaster. He adds that Eskom will be spending large amounts of monies on lawyers, courts and the applicants of the cases.

Quite frankly, I think he [Brian Molefe] might have a case.

Bagraim goes on to say that Molefe may be able to prove that he hasn't been treated well in relation to labour laws. South Africa is regulated by some of the best labour laws in the world he says.

We must understand that in our labour laws today we have to first the reasons why you are getting rid of a person and then you have to follow a proper process.

Michael Bagraim, labour lawyer

Bagraim suggests Minister Brown may have been under pressure and therefore told Molefe to go. The minister has really destroyed what is in fact a good case for Eskom by dismissing Molefe says Bagraim. He says Molefe is entitled to be heard.
