Is secret recording between Panayiotou and middleman admissible in court?

Advocate Manny Witz analyses the legal implications of the video showing a secret recording between Panayiotou and the alleged middleman in the murder of his wife Jade two years ago.

There was an amendment to the Criminal Procedure Act that allows for trapping. And in terms of that section where they are allowed to trap people you have to get permission from the Director of Public Prosecutions.

The permission is time bound and strict procedure has to be followed as our Constituent protects the rights of individuals.

The courts are quite strict with regards to how they look at and under what circumstances they will admit it. But it is allowed in terms of the Act.
