Absa: Public Protector has not explained her different findings to Davis panel

Absa has explained its reasons for a court challenge against the findings of the Public Protector Busisiwe Mkhwebane .

Spokesperson Songezo Zibi explains to Stephen Grootes why it believes she has behaved in a legally irrational manner.

We believe the Public Protector's findings are wrong and irrational.

He says the findings moved from using the testimony of Dr Chris Stals to using the findings of the Davis panel of experts, yet with a different outcome in terms of the determination of the liability.

She does not explain why she differs from the Davis panel's findings and has not given an explanation, he adds

In January Absa asked for the original documents from which she drew her conclusion and she refused to provide them.

He says Absa does not want to speculate on the motives behind the findings at this stage.

The remedial action that Constitution be amended is not something Busisiwe Mkhwebane is empowered to do as the Public Protector, he says.
