Supreme Court of Appeal opposes van Breda trial live-streaming

The court proceedings of murder-accused Henri van Breda will not be live streamed as per the ruling of the Supreme Court of Appeal (SCA) in Bloemfontein. Media24 had previously sought permission to have the van Breda trial live-streamed.

Dario Milo, Media and Information Lawyer, Webber Wentzel says the result is a bit misleading.

As a result of technological developments and the law relating to open justice, the default principle in every court case must be permitted that they broadcast in their entirety.

If a witness or the accused has a valid objection as to why he or she shouldn't be broadcast, that will then be considered by the trial judge hearing the case.

But Judge Desai did not grant them leave to appeal and van Breda's defence team took it to the Supreme Court.

Milo says what the SCA may have said in setting aside Judge Desai's judgement, was the possibility of it being too broadly expressed.
