"Mkhwebane initially denied the report's existence so she has lied"

The office of Public Protector Busisiwe Mkhwebane announced on Monday that she would not oppose a court application by the Reserve Bank to overturn her finding in the CIEX report in which she ordered Parliament to amend the Constitution to change the mandate of the South African Reserve Bank (Sarb).

Head of Accountability Now, Advocate Paul Hoffman says Mkhwebane's response is long overdue and he agrees with those that say she should pay the costs.

The report is either the product of incompetence or something more sinister.

Hoffman says Mkhwebane lied about the preliminary report back in January. He says he received an inquiry about the report and confronted her about it. Mkhwebane denied the existence of the report.

He says an inquiry into Mkhwebane's fitness to hold office should be launched by the Parliamentary Justice Committee.

The Public Protector's spokesperson Cleo Mosana earlier told Eusebius mcKiaser that her boss did not get the law wrong and only made a 'drafting and crafting' error.

Deputy Minister of Public Enterprises Enoch Godongwana says Mkhwebane made a right decision in dropping her opposition to the Sarb review application.

He says he doesn't think Mkhwebane's opposition would stand legal scrutiny.

I said, when the report was published, that it does not make economic sense to create an environment where both fiscal and monetary policies are not coordinated in one place.

Godongwana says debates on the Reserve's bank's mandate have been put to bed because it was discussed at the ANC's Policy Conference.

Conference resolved that the mandate of the Reserve Bank in terms of the Constitution must remain and the only issue that was raised was the ownership structure.

Head economist at Econometrix, Dr Azar Jammine says Mkhwebane's decision to concede did a lot of damage and "upset the apple-cart" with regards to what people perceived to be the independence of the Reserve Bank.

This incident highlighted how certain factions are trying to capture the economy of the county, says Jammine.

The damage might not be as permanent as some people would like it to be.
