Guptas may not have broken the law with business visa - Immigration attorney

A story in the Citizen newspaper on Friday morning suggests that the Gupta family may have broken the law when they were on temporary business and residence visas before they applied for permanent residence and were then granted citizenship by now finance minister, Malusi Gigaba.

Gary Eisenberg, Immigration Attorney, says the interpretation by the newspaper isn't one hundred percent correct adding that you have to assess their permits and see what they say.

If government has written down on an individual's permit that they may run a group of companies, then that's the permission a person has.

Gary Eisenberg, Immigration Attorney

In order to get citizenship you have to be a permanent resident. As a permanent resident permit holder you are free to do whatever you want to do.

Gary Eisenberg, Immigration Attorney

There are very little conditions attached to permanent resident permits in relation to prohibitions to pursue a business activity.
