Our mandate is to prosecute not to investigate - NPA spokesperson

An article in the Times on Monday morning claims that the National Prosecuting Authority was aware of alleged wrongdoing by companies owned by the Gupta family twelve years ago but declined to prosecute.

The newspaper says that Sahara Computers and Trump Technology were investigated by the Scorpions at the time for customs fraud between 1999 and 2001. The probe finished in 2003 but the NPA said it would not prosecute in 2005, the report says.

Luvuyo Mfaku, NPA spokesperson says the docket was not destroyed but after any prosecution, it is returned to the police.

Mfaku says when the National Director of Public Prosecutions briefed the Standing Committee on Public Accounts (Scopa) in May, he indicated to them that the Public Protector referred the state of capture report to the national director. He then referred it to the head of the Specialised Commercial Crime Unit (SCCU) and appointed a team of prosecutors to work closely with the Hawks in their investigation into state capture.

Those prosecutors are engaging with the Hawks.
