"Companies have every right to monitor employee communications"

Social media law expert, Emma Sadlier says saying things on social media in one's personal capacity doesn't exist anymore - what you say will always be linked to your employer.

Sadler was commenting on the news that FNB has fired four of its employees after their emails and WhatsApp messages were monitored.

FNB stated that the four made disparaging comments about DA leader Mmusi Maimane and his wife in a Whatsapp conversation and emails on devices owned by the bank.

Often your views are inextricably linked with the views of the employer. This means a lot of people find themselves in trouble when they did not know they can get into trouble.

Sadlier says companies have every right to monitor employees communications. She says according to Rica, companies are not allowed to intercept direct communication unless there is prior consent from either of the parties.

If you are using the work network or work device, provided you have been notified that the company will be spying on you.. then the company can monitor you.

This can be done in employee contracts.

That's fairly standard practice, every employment contract that I've come across, there is notice that the company will be watching you.
