Opposition parties want ConCourt to find that Mbete failed to act against Zuma

The Constitutional Court is hearing an application by opposition parties to declare that the National Assembly failed in it's constitutional mandate to hold President Jacob Zuma accountable over the Nkandla scandal.

The Economic Freedom Fighters (EFF), United Democratic Moevement (UDM), Congress of the People (Cope) and the Democratic Alliance (DA) filed an application in a bid to have President Jacob Zuma face impeachment proceedings.

They say Zuma failed to implement the Public Protector’s remedial action that he pay back the money for the upgrades to his Nkandla home.

The EFF says it's disturbing that the speaker of the National Assembly, Baleka Mbete, continues to shift the responsibility of holding the executive accountable.

Eyewitness News reporter Gia Nicolaides has more.

They want this court to declare that the speaker has failed to put all these processes in place to hold the President accountable, but also to order the speaker to convene a committee of Parliament or other independent body to investigate the President's conduct.

What we have heard from advocate Ngcukaitobi, is that they feel that not enough has been done and that the national assembly has not scrutinized the President with regard to the Nkandla matter.

Meanwhile Constitutional law expert Pierre de Vos explains the heart of the argument.

This whole case really is about the separation of powers between the court in the one hand and the other two branches on the other hand, but also between the two political branches - the legislature and the executive.

The question that the EFF, Cope and the UDM is trying to get the court to answer is what is it that Parliament must do to hold the executive accountable and to what extent the court can interfere to make the party do what they are supposed to do.
