Mogoeng Mogoeng gives opposition parties a tough time over impeachment bid

The Economic Freedom Fighters (EFF) says it wants the Constitutional Court to determine whether President Jacob Zuma’s conduct is impeachable.

The EFF together with the United Democratic Movement (UDM), Congress of the People (Cope) and the Democratic Alliance (DA) have filed an application in a bid to have Zuma face impeachment proceedings in the National Assembly.

EWN reporter, Gia Nicolaides was at the ConCourt hearing and says arguments from the three councils, representing the opposition parties have been rather similar.

Mainly because they are all asking for the Constitutional Court to declare that the National Speaker of Parliament has failed to put in place the necessary mechanism to hold the President accountable following his failure to implement the Public Protector's remedial action, and that was to pay some of the money of the Nkandla upgrade.

They also want the Court to say that an inquiry should take place.

The purpose of this application is to compel the National Assembly to carry out its constitutional function by convening a committee of Parliament or an independent body to investigate whether Zuma's conduct was inappropriate. The aim would be to determine whether he is guilty of any offense to warrant an impeachment, reports Nicolaides.

Chief Justice Mogoeng Mogoeng has been the main interrogator, asking all three councils, what is there investigate?

Nicolaides reports that Mogoeng implied that the EFF wants to merely kill the President's term of office earlier because every other motion of theirs have been unsuccessful.

Mogoeng wants to ensure the ConCourt does not override the role and responsibility of the National Assembly, she adds.

She says that friends of the Court, Corruption Watch, and lawyers representing, Baleka Mbete, Speaker for the National Assembly are still to present their case on Tuesday afternoon.
