NPA describes Pistorius sentence as "disturbingly inappropriate"

The National Prosecuting Authority (NPA) is appealing the six year prison sentence for athlete Oscar Pistorius in the Supreme Court of Appeal in Bloemfontein.

The NPA argues that the sentence is "shockingly, startlingly and disturbingly inappropriate".

Pistorius shot and killed his girlfriend, Reeva Steenkamp on Valentine’s Day in 2013.

EWN senior reporter, Barry Bateman has been reporting on the appeal.

He tells Midday Report stand in host, Ray White that one of the state's main submissions was that Pistorius has not shown remorse and that the High Court misdirected itself in elevating his regret for committing the crime to that of remorse.

You cannot have proper remorse if you do not accept the extent of the crime committed and the damage you have done. And Oscar Pistorius has maintained that he has apologised for accidentally killing Reeva Steenkamp.

He has never stated that he apologises for intentionally killing his girlfriend. Therefore, in the sentencing it can never be accepted that he has shown remorse and therefore given a lesser sentence.

Bateman reports that the state is also arguing that Judge Thokozile Masipa did not properly list all the mitigating factors and the aspect that she did take into account, such as Pistorius' fear and disability should not have counted because there is case law that states with serious crimes retribution and deterrence should have come to the fore over and above those mitigating factors.
