The Road Accident Benefit Scheme proposes compensating the victims of road accidents, irrespective of if they are at fault or not.

A personal injury law expert has warned that government's proposed Road Accident Benefit Scheme Bill will not adequately compensate the victims of road accidents.

The Scheme proposes compensating the victims of road accidents, irrespective of whether or not they are at fault.

The new law will eventually replace the existing Road Accident Fund (RAF).

Kirstie Haslam, head of DSC Attorneys, says the new no-fault system will see the unfair distribution of compensation to drunk and negligent drivers.

The Road Accident Benefit Scheme is a departure from a lump sum payout, and moves towards more specific claims that can provide prolonged income support.

According to Haslam, the increase in direct claims may lead to a decrease in the average value of claims paid out.

What is going to happen is a complete decimation of benefits.
