NPA declines to prosecute former acting top cop Phahlane

PRETORIA - The National Prosecuting Authority (NPA) has confirmed to Eyewitness News that it has decided not to prosecute former acting National Police Commissioner Khomotso Phahlane on charges of defeating the ends of justice.

The charges relate to allegations that Phahlane interfered in police watchdog Ipid’s fraud and corruption investigation of him.

Eyewitness News revealed last week that Ipid has expanded its probe and has identified the source of cars apparently sponsored to Phahlane as being paid for by a major police supplier.

The NPA’s Luvuyo Mfaku confirmed that it has decided not to prosecute Phalane on a charge of defeating the ends of justice because there is no reasonable prospect of success.

Ipid had accused Phahlane of contacting witnesses in their investigation of his luxury home at an estate in the north of Pretoria.

It is alleged that the major-general paid for the property using kickbacks from suppliers whom he allegedly helped secure tenders.

Phahlane has consistently denied any wrongdoing.

Ipid’s Moses Dlamini says they have written to the Director of Public Prosecutions to ask for a review of the decision not to prosecute.
