There is confusion over Former Eskom CEO Brian Molefe's argument in the North Gauteng High Court on Wednesday.
Molefe's lawyers told the court that he had retired from the parastatal on the basis of early retirement, but this was ruled invalid. The lawyers argued that Molefe cannot be blamed for misunderstanding what he was entitled to in terms of early retirement and that he should be able to continue as Eskom CEO.

That takes you to the position then when Brian Molefe did not resign, if the court accepts that, then he wants the court to accept that he never left Eskom. In other words if he did not say he is resigning and his retirement was overturned, then in law at least he never left Eskom.— Phillip de Wet, journalist
