Casac to challenge Zuma's appeal of Abrahams High Court order

The National Prosecuting Authority (NPA) and President Jacob Zuma have indicated that they will appeal a High Court order that head Shaun Abrahams leave office and be replaced within 60 days.

The court ordered that the R17 million golden handshake paid to former NPA head Mxolisi Nxasana by Zuma be paid back and that he not be reinstated.

Ray White spoke to Executive Secretary of the Council for the Advancement of the South African Constitution (CASAC), Lawson Naidoo.

We will be applying directly to the Constitutional Court for a confirmation order in terms of section 170 of the Constitution which says that any finding by a court of unconstitutionality has to be confirmed by the Constitutional Court.

Casac's application will be made directly to the Constitutional Court within the next 48 hours, confirms Naidoo.

There is no point in going to the Supreme Court of Appeal in this case. This is an order that needs to be confirmed by the Constitutional Court.
