The revelation of a draft of State of Emergency regulations caused quite a stir this week as the origins of the draft were unknown.
A article by the Rapport Newspaper showed that this draft was endorsed by the South African Defence Force (SANDF) and seemed to emanate from the Presidency. The Presidency denied that it came from them.
Shannon Ebrahim, Foreign Editor at Independent Media Group say that the draft comes from the Justice Department and was created in 2016.
I did speak to someone very well placed and senior in the Justice Department who will remain anonymous. They did confirm to me that these regulations were drafted by Justice in 2016 and that they had formed this task force.— Shannon Ebrahim, Foreign Editor at Independent Media Group
Ebrahim says the the process was never taking forward because there were constitutional concerns. She adds that while the SANDF endorsed the draft regulations, they will have to be revised.
