Gauteng Education says language and capacity no excuse to turn away pupils

The Gauteng Education Department has argued that language and capacity may not be used to stop the admission of a pupil at a school.

The department has been making legal arguments in the High Court in Pretoria in a battle against Afrikaans school Hoërskool Overvaal, reports EWN's Barry Bateman.

Irrespective of language or capacity, that is not a problem for the school. The department is saying you must admit the child.

Hoërskool Overvaal is applying to interdict the department from admitting 55 English-speaking pupils to the Afrikaans school.

The school told the court that it does not have enough space to accommodate the learners.

They maintain that there are English schools in the area that have space readily available.
