Judge Kriegler: It's not about Nxasana, but the legalities of Zuma's conduct

The High court ruled last year that the termination of former NDPP head Mxolisi Nxasana was uncostintutional.

This has prompted the prominent civil societies the Helen Suzman Foundation, Corruption Watch, and Freedom Under Law to approach the Constitutional Court to ask for the reinstatement of Nxasana.

Former ConCourt Judge, currently with Freedom Under Law, Johann Kriegler says the December case was about the unlawfulness of the President forcing Nxasana out of office and replaced with his favoured appointee.

We would like the Constitutional Court to confirm the Pretoria Court findings that the President and the minister acted unlawfully when they forced Nxasana out of office.

Nxasana was given a R17 million golden hand-shake during the inquiry into his fitness to hold office in 2015, but the courts have since ruled that he must pay back the money.

Nxasana is happy to pay back the money and we are happy to support him in his pleas for reappointment.
