Did Gigaba lie to South Africans about the #Guptas?

Following Tuesday's press briefing in which re-appointed Home Affairs minister Malusi Gigaba sought to clarify the status of members of the Gupta family, a local immigration attorney claims Gigaba made some 'fundamental errors'.

The minister confirmed that Ajay and his brother Atul Gupta are not South African citizens.

He claimed the Guptas chose to apply for naturalisation as a family and that all applications were rejected in 2014, due to some members not meeting the criteria.

He said they later appealed and the rejection was over turned, but they were never granted citizenship because they refused to denounce their Indian citizenship.

But Immigration attorney Gary Eisenberg has poked holes in the claims by Gigaba and the DG of Home Affairs Mkuseli Apleni.

There is no appeal process in the South African Citizenship Act, it is not possible to appeal, it is only possible to re-apply a year after the first rejection.

A photograph of what's purported to be Atul Kumar Gupta's passport is currently making the rounds on social media, but Gigaba has denied it is proof of the Guptas having South African citizenship.

The date of issue on the passport is 31 July 2015, which was during Gigaba's tenure as Minister of Home Affairs.
