CIPC lays criminal charges against tech firm SAP over Gupta-linked contracts

German software company SAP announced on Thursday it had found irregularities in connection with the Eskom and Transnet contracts it facilitated.

This is after SAP completed its investigation into South Africa’s contracts relating to Gupta-controlled firms by law firm Baker McKenzie.

SAP admitted it paid more than $8 million to intermediary companies controlled by the Guptas.

The Companies and Intellectual Property Commission (CIPC) laid a criminal complaint against SAP in connection with the contracts.

Senior Manager of Enforcement at the CICP, Lana van Zyl, says the firm contravened section 2141 C of the Companies Act.

Section 2141 C of the Companies Act specifically refers to reckless conduct and non-compliance and it provides that the person is guilty, if they were a party to an omission or an act calculated to defraud the creditor or employee of the company or a holder of the company's securities.

CIPC opened a criminal case with the South Africa Police Service. It is now for Saps to investigate the matter, but we are assisting them with the information they might need.

Van Zyl says they have also opened criminal cases against KPMG and McKinsey.
