Fresh claims Tom Moyane fast-tracked fake R70m VAT payments to Gutpas

The country's tax head Tom Moyane is at the centre of fresh allegations that he pushed through unlawful VAT payments to Gupta-linked company Oakbay.

The Daily Maverick's investigative unit claims the South African Revenue Services (Sars) Commissioner authorised tax refunds to the firm of R70-million.

The background to the current investigations is that Tom Moyane seems to have pressured Sars officials to illegally fake three VAT payments to the Guptas.

The first payment a R70-million rand payment and then there were two smaller payments, and this all happened in June, July and August last year it seems.

Speaking to Kieno Kammies, the Daily Maverick's Paulie van Wyk says the online newspaper is in possession of documents to support the allegations and, in addition, a whistle blower's first hand account.

Van wyk says Moyane pushed through payments to a third party for the benefit of Oakbay.

When you have to pay a VAT refund you cannot pay it into a third-party's bank account and obviously this did not happen.

In two weeks from their first request the Gupta's were paid out the 70 million, we juxtaposition that to a story where a multi national company had a VAT claim of R195-million rand and they've been waiting for nearly a year.

The Daily Maverick says it has documents showing Moyane authorised the transfer of the funds, despite being warned against the payments.

Sars has denied that anything unlawful took place, while Moyane claims the payments had to be made to a third party because Oakbay's bank accounts had been closed.
