Political Desk: Will the ANC 'do a de Lille' on Mahumapelo?

With the situation surrounding Supra Mahumapelo's future in the North West decidedly unclear, one constitutional expert says his decision to take leave of absence is legally dubious.

Phephelaphi Dube from the Centre for Constitutional Rights says there is no provision in the constitution for Mahumapelo to take a such leave.

His decision really opens himself up to a lot of legal challenges going ahead. In a nutshell there is no legal basis for him to have taken this decision.

Mahumapelo appointed Finance MEC Wendy Nelson as acting premier in his absence.

Dube says the African National Congress has two options as to how it can deal with Mahumapelo.

The first option will be to rescind his membership of the governing party and once that happens it means his position as Premier of the North West will simply fall away.
