The Democratic Alliance (DA) and Afriforum have approached the Pretoria High Court to have the International Relations Department’ s decision to grant former Zimbabwe first lady Grace Mugabe amnesty, reviewed and set aside.
On Thursday, the court heard former First Lady Grace Mugabe should never have been granted diplomatic immunity - because she was not entitled to it.
Mugabe assaulted model Gabriella Engels at a hotel last year without being prosecuted.
Eyewitness News reporter Barry Bateman has more on the story.
They [ the state] are referring to international law, saying that as the spouse of a head of state she was entitled to this, thus they obliged and granted her immunity from prosecution. The party here is saying that is an incorrect interpretation of international law, there is a discretion allowed here.— Barry Bateman, EWN reporter
They are also saying, given the seriousness of this particular crime, it was irrational and against the law considering the crime that she had allegedly committed.— Barry Bateman, EWN reporter
One of the questions that the court was faced with today was whether the immunity actually applies to Grace Mugabe now that Robert Mugabe is no longer head of state. The judge has been asked as part of the application to rule in that particular respect.— Barry Bateman, EWN reporter
