It's up to the court's interpretation of De Lille's radio interview - law expert

Constitutional law expert Professor Pierre de Vos weighs in on the case involving Patricia de Lille vs the DA.

De Vos says the court will have to make an interpretation of what was said by De Lille. The DA rescinded her membership saying that De Lille said in an interview on The Eusebius McKaiser Show on CapeTalk and 702 that she intends to leave the party.

Patricia de Lille is challenging in court the Democratic Alliance’s decision to rescind her party membership.

It could be interpreted both ways. You have to look at the provision of the DA and why it was input into their constitution.

If you look at de Lille's statement in context, you might say, oh okay she actually made it conditional so it doesn't apply to her.

Professor Pierre de Vos, Constitutional law expert

In a case like this where nobody is disputing what was said - so there is no dispute of that - there are certain rules that apply to that.

But here the court will just have to make an interpretation.
