Dr Yvette Nel who was recently engaged in legal services to challenge the Independent Electoral Commission on the Mental Illness Act has raised concern on the definition of mental illness in electoral law, as well as a lack of access to voting stations.

Pointing to a number of loopholes, Nel says the act has long discriminated against mentally ill people.

It is not clear really. It seems to be a blanket discrimination against a group of people without clarifying what sort of impairment is being spoken about in terms of the phrasing of the act.

There is this concept that if you are detained under the Mental Healthcare Act, you have lost all your cognitive abilities and we know that is not true and that is one of the main starting points as to what is wrong with the act as it currently is.

The reality is that the IEC has not been setting up polling stations or temporary stations in terms of voting at psychiatric facilities.

She says voting is a fundamental right.

This sort of arbitrary restriction in terms of mental healthcare users, it really does not make any sense.
