Sheilds says the passengers who were injured and the family of the deceased have a legitimate claim against the rail service.

It comes as the Regional Manager at Western Cape Metrorail, Richard Walker passed his condolences to the family of the deceased.

It's believed the passenger died following a suspected arson attack on a commuter train at Ottery Station on Wednesday.

Four other passengers were injured.
