'It's up to Ramaphosa to decide on Moyane's bid to have Sars Inquiry postponed'

Suspended tax boss Tom Moyane's legal team will approach President Cyril Ramaphosa in an attempt to have the Sars inquiry put on ice.

On Monday, Judge Robert Nugent rejected Moyane's request for the Sars Inquiry to be postponed until his disciplinary hearing is concluded.

Moyane's laywer Eric Mabuza insists that the decision can be reviewed.

Nugent is sitting there, not as a judge, but as a commissioner, so his decisions are reviewable in court.

Eric Mabuza, lawyer representing Tom Moyane

We are going to raise the very same complaint that we raised before commissioner Nugent, to President Ramaphosa.

If you look at the rulings in totality and compare it to what he said on Friday, you will find that there is glaring inconsistencies, so we are not perturbed by his ruling. We are confident that we ill be successful to overturn them on review.

Mabuza says they have already written to Ramaphosa and that it is up to him to decide.

We have already raised the issues with President Cyril Ramaphosa. We sent him a letter today where we specifically asked him to disestablish one of the two inquiries or both of them and to remove Professor Michael Katz as one of the commissioners... the ball is rolling, it is up to Ramaphosa now to decide which way he wants to go.
