Abrahams judgement has potentially profound political implications - Analyst

Legal experts and political analysts have been reacting to Monday's ConCourt ruling that the appointment of Shaun Abrahams as head of the NPA was invalid.

Speaking on 702, Political Analyst Professor Richard Calland says the judgement has been long awaited.

Earlier the ConCourt ruled as unconstitutional the manner in which former National Director of Public Prosecutions (NDPP) Mxolisi Nxasana was removed from office by President Zuma.

The Constitutional Court has ordered President Cyril Ramaphosa to appoint a new National Director of Public Prosecutions within 90 days.

Calland says even though it is a legal judgement it will have 'potentially profound' political implications for the rule of law and accountability and for the democratic credentials of this country.

This is a long-standing problem and if the president appoints a competent, independent-minded person of integrity who fits the job description of the NPA act as the court is asking him to.

Then we will have an NDPP who fulfils the criteria and who is lawfully appointed for the first time in a decade.

The professor adds that the declaration of invalidity in relation to the appointment is no longer and lawfully the holder of that position.

And that the president has been given a certain period of time in which he must now fill that vacancy.

He says in the meantime, there would have to be some sort of acting director appointed to hold the ship afloat during that period.
