President Ramaphosa to appoint acting NDPP from within NPA

The Constitutional Court has given President Cyril Ramaphosa 90 days to appoint a new head of the National Prosecuting Authority.

This comes after the court's ruling on Monday that the appointment of Shaun Abrahams as successor to Mxolisi Nxasana as head of the NPA, was unconstitutional and invalid.

Former president Jacob Zuma appointed Abrahams following the unlawful removal of Mr Nxasana. The Court said Nxasana's removal was an abuse of power from Zuma.

Spokesperson to President Cyril Ramaphosa, Khusela Diko says that the President has noted the judgment by the Constitutional Court.

For us it brings the issue of credibility at the NPA closer to finality. The President has been talking about the need to restore the integrity and credibility at that institution.

So yesterday's ruling gave the President room to be able to act swiftly in that regard. He has made a commitment to the appointment of the acting director of the NPA, which could be as soon as today.

Diko says the NPA act stipulates clearly that upon consultation with the minister, the position of the acting director should be filled by someone within the ranks of the NPA.

She says that the Constitutional Court only made a ruling on the process in which Abrahams was appointed as head of the NPA but there was no process which looked at his fitness to hold office or that of the other deputies within the NPA like Nomgcobo Jiba.

At this particular moment, there is no discretion that they are not fit and proper to hold office.
