DA, new NMB coalition to face off in court on Thursday

The Democratic Alliance (DA) and the newly formed Nelson Mandela Bay coalition government will go head to head in the Port Elizabeth High Court on Thursday.

The DA is challenging the outcomes of last month's council meeting that resulted in Trollip being ousted as mayor.

Speaking to Africa Melane, political analyst based at Nelson Mandela University, Ongama Mtimka says the court is going to explain to the public.

Because the right to deploy somebody is there in the Structures Act. The Act, for example, says the person who must preside over a council meeting wherein the speaker has been voted out, it must be the acting MM or a representative sent by the MEC when the MM is not available.

So the question is whether the court will accept that Johan Mettler was available when he had left the meeting and expressed the intention to rather call it later which procedurally is not allowed.

Because the only time you can postpone a council meeting is when it is deadlocked in electing the new speaker.
