Judge Robert Nugent: My recommendation stands that Moyane must go

Judge Robert Nugent has an interim report into his commission of inquiry into Sars.

In the report, Nugent recommends that President Cyril Ramaphosa replace suspended Sars commissioner Tom Moyane immediately.

EWN reporter Barry Bateman says on Thursday, Nugent clarified while the report is an interim report, the recommendations are final and will not change.

This comes after some media reports have been speculating that the findings and recommendations might change in the final report which is due to be released at the end of November.

He is saying that their findings and conclusions in this particular report are final and recommendations would not change by the time they get to the final report, which they would submit at the end of November.

Bateman reports that the commission has received criticism from Moyane's Lawyer Eric Mabuza who says that the commission cannot release the report without concluding the process. Mabuza added that there is still a long way to go and therefore the report is premature.

In his response, Nugent said that the commission has written to Moyane on several occasion, as and when they gathered new evidence, to obtain his response but none was forthcoming.

He then stressed that the revenue service urgently needs new leadership and stability, which is why they made this recommendation to President Cyril Ramaphosa in the interim report.

We do know that President Cyril Ramaphosa has given Tom Moyane until Friday to respond to this report.

According to Bateman, Judge Nugent has also clarified the issues around the Sars IT system following reports that it is on the verge of collapse.

The evidence presented is that the infrastructure is aging and needs to be maintained and upgraded but it is not at the stage of collapsing.

He says if we don't upgrade the system, some time down the line it will get to a position where it collapses but we are not at that stage yet. He urged South Africans to pay their taxes.
