ConCourt boots out Moyane's application

The Constitutional Court has dismissed former Sars commissioner Tom Moyane’s bid to challenge the validity of the Nugent Commission of Inquiry that recommended he be fired.

Moyane was supported by former President Jacob Zuma in an affidavit, who argued to the court that Judge Nugent had no authority to recommend Moyane’s firing.

EWN reporter Barry Bateman says Moyane filed an affidavit earlier this week in relation to that matter in the High Court.

Where Moyane argues that this matter is urgent and Robert Nugent saying the real urgency here is to have a permanent appointment at Sars so we can start rectifying the damage that has been caused to this organisation by Moyane.

Bateman reports that Judge Robert Nugent defended his interim report and his recommendations to fire Moyane saying that the president was entirely within his rights to act on those recommendations.

He says Moyane has also approached the North Gauteng High Court on an urgent basis for relief following his dismissal.
