'Ingonyama Trust case an example of issues facing land restitution claimants'

The Land Claims Court has not approved a bid by Zulu King Goodwill Zwelithini to order his subjects to share land they won back in a successful land claim.

This week the court slapped Zwelithini's controversial Ingonyama Trust with a cost order in the failed bid.

The Ingonyama Trust apparently wanted 11 000 hectares of bordering land, being claimed by the Entembeni, Makhasaneni and Mthonjaneni communities, awarded to the trust.

Law prof Elmien Du Plessis says the case is a testament to the complexities that restitution claimants are faced with when they want to claim their land back.

She explains that communities don't want the power of land ownership vested solely in traditional leaders.

The communities say that traditional leaders do not have the power to make these decisions on the community's behalf.
